Home Services Contact Privacy Policy

These Terms of Service govern the use of this website and the professional services offered by BATT INS. AND FIN SVCS. INC. By visiting this site, sending a message to the office, or engaging the office for a review or another route, a person agrees to the terms set out on this page. Please read them carefully before relying on anything on the site.

BATT INS. AND FIN SVCS. INC. is located at 116 N Adamswood Rd Ste 2, Layton - 84040-4004, United States (US). The office may be reached at billing@battinsfin.hair or by telephone at +12232230928. These terms are written in plain language so that a client can understand the arrangement without legal training.

Where these terms conflict with a separate written engagement agreement signed by the office and a client, the signed agreement governs for that engagement. These terms govern everything else, including ordinary use of this website.

1. Acceptance of These Terms

By accessing this website, a visitor accepts these Terms of Service in full. Acceptance occurs when a visitor loads a page, sends a message through the contact form, or contacts the office by email or telephone in response to something found on the site. A person who does not accept these terms should stop using the site.

These terms apply together with the Privacy Policy published on this site. The Privacy Policy explains how information is collected and handled, and it is incorporated into these terms by reference. A person who accepts these terms also acknowledges the Privacy Policy.

Where a client engages the office for a service, the engagement is also governed by any separate written agreement between the office and the client. If a signed agreement addresses a topic differently from these terms, the signed agreement governs for that engagement, and these terms continue to govern ordinary use of the website.

The office may revise these terms from time to time as described in Section 20. Continued use of the site after a revision takes effect constitutes acceptance of the revised terms.

2. Eligibility to Use the Site

This website is intended for adults who are at least eighteen years of age and who have the legal capacity to enter into an agreement. By using the site, a visitor represents that the visitor meets these requirements.

If a visitor uses the site on behalf of a business, a family member or an estate, the visitor represents that the visitor is authorized to do so. The office may ask for confirmation of that authority before acting on a request, particularly where a request concerns a beneficiary record or a claim.

The office reserves the right to decline a request or to discontinue a service where eligibility cannot be confirmed, where a request appears to be fraudulent, or where the office cannot lawfully provide the service in the location of the person making the request.

A person who uses the site from outside the United States is responsible for complying with the laws of that location, to the extent those laws apply to the use.

3. The Services of the Office

The office provides six services at the ledger desk: Policy Folio Reviews, Claim Route Planning, Beneficiary Record Audits, Premium Schedule Counsel, Coverage Gap Surveys and Renewal Watch Services. These services are described in more detail on the services page of this website, and that description is part of these terms.

A Policy Folio Review is a reading of the policies a client holds, producing a written summary of what each folio does. Claim Route Planning is the preparation of a written plan for handling a loss. A Beneficiary Record Audit is a reconciliation of designations across carriers. Premium Schedule Counsel is the preparation of a calendar of payments and due dates. A Coverage Gap Survey is a written list of exposures between policies. Renewal Watch Services is the comparison of each renewal against the term it replaces.

The office provides these services with reasonable care, skill and diligence. The office does not guarantee a particular outcome, because outcomes depend on carriers, adjusters, courts and events outside the office control. The office promises the quality of its work, not a result.

The scope of each engagement is confirmed in writing before work begins. A service that is outside the confirmed scope is a separate engagement, and the office will not begin it without the client agreement.

4. No Insurance or Legal Advice

Nothing on this website is insurance advice, legal advice, tax advice or investment advice for a specific person. The content on the site is general information about the services of the office and about the work of a mutual aid ledger desk. It is not a substitute for a reading of the actual policies a person holds.

The office is not a law firm and does not practice law. The office does not provide a legal opinion on coverage, on liability, on the interpretation of a contract or on any dispute. Where a matter requires a lawyer, a tax professional or another licensed expert, the office will say so and will encourage the client to seek that help.

A person who needs advice about a specific policy should request a Policy Folio Review and provide the actual documents. Until the office has read the actual documents, anything said about coverage is preliminary and should not be relied upon as final.

Statements about coverage, eligibility or claim outcomes are always subject to the terms of the policy and to the decisions of the carrier. The office does not control a carrier decision, and it does not represent that a carrier will act in any particular way.

5. Accounts and Contact Information

This website does not require a visitor to create an account. A person who contacts the office provides contact details through the contact form, an email or a telephone call. These details are used to respond and to maintain the file as described in the Privacy Policy.

A person who provides contact information agrees to keep it accurate and current. Where an email address or a telephone number changes, the person should tell the office so that important notices can still be delivered. The office is not responsible for a missed notice caused by contact details that are out of date.

The office may send service related messages to the contact details on file. These messages are part of the work and are not marketing. A person may ask the office to use a different channel where that is practical for both parties.

6. Client Responsibilities

A client is responsible for providing complete and accurate information. A review, a route plan or an audit is only as good as the documents behind it. Where a document is missing or a fact is stated incorrectly, the resulting summary may be incomplete, and the client should not rely on it as if it were complete.

A client is responsible for reading what the office delivers. When the office sends a summary, a route plan or a list of exposures, the client should read it and raise any question. The office prefers a question to a misunderstanding, and it welcomes requests for clarification.

A client is responsible for the decisions the client makes. The office advises; the client decides. Where the office recommends closing a coverage gap or correcting a designation, the client chooses whether to act. The office will implement a client instruction within the agreed scope, but it will not act contrary to a client instruction.

A client is responsible for meeting the obligations of the client policies, including the payment of premiums and the timely notice of a loss. The office supports these obligations but does not assume them on the client behalf.

7. Fees and Payment

The office charges a fee for the services it provides. The amount of a fee and the basis for it are stated in writing before work begins. A client who disagrees with a proposed fee may decline the engagement, and no work will begin until the fee is agreed.

Unless a written agreement says otherwise, fees are due within the period stated on the invoice. The office may pause work on an overdue engagement, and it will give notice before doing so. Questions about an invoice are welcome at billing@battinsfin.hair.

Where a service is provided in stages, the office may invoice each stage separately. Where a service is cancelled before completion, the office may invoice for the work already performed, calculated on a reasonable basis tied to the agreed fee.

The office does not pay or receive a commission for recommending a carrier. Fees are for professional work and are disclosed in advance. Any change to a fee for an ongoing engagement is communicated before it takes effect.

8. Scheduling and Cancellation

The office works by appointment during business hours. An appointment may be requested through the contact page, by email at billing@battinsfin.hair or by telephone at +12232230928. The office confirms an appointment before it is considered firm.

A client who needs to reschedule or cancel should give as much notice as is practical. The office understands that plans change and asks only for the courtesy of notice, so that the time may be offered to another client.

Where a client does not attend a confirmed appointment without notice, the office may apply a reasonable fee for the reserved time, if that fee was disclosed in advance. The office will always explain the basis for such a fee before applying it.

The office may reschedule an appointment when necessary. If the office must reschedule, it will offer an alternative time as promptly as it can and will not apply any fee for the change.

9. Accuracy of Information on the Site

The office works to keep the content of this website accurate and current. Even so, the site is general in nature and may not reflect the most recent change in a carrier practice or in the law. A person should confirm any detail with the office before relying on it for a decision.

Descriptions of the six services on this site are summaries. The full terms of an engagement are set out in the written agreement for that engagement. Where a summary on the site and a written agreement differ, the written agreement governs.

The office may correct, update or remove content on the site at any time without notice. The office does not promise that the site will always be available or free of error, and it does not promise that a defect will be corrected within a particular period.

10. Intellectual Property

The content of this website, including its text, its visual design, its layout and its source code, is owned by BATT INS. AND FIN SVCS. INC. or is used with permission. The content is protected by copyright and other laws. These terms do not transfer any ownership of that content to a visitor.

The name BATT INS. AND FIN SVCS. INC. and the wordmark used on this site are identifiers of the office. A visitor may refer to the office by name in an ordinary way, but may not use the name or the wordmark in a manner that suggests a partnership or an endorsement that does not exist.

A visitor may print or save a page for personal reference. A visitor may not republish the content, sell it, use it to train a system, or present it as the visitor own work. A request for permission to use content in another way may be sent to billing@battinsfin.hair.

11. Limited License to Use the Site

The office grants a visitor a limited, revocable, non exclusive license to view this website for personal and lawful purposes. The license does not permit a visitor to modify the site, to reproduce it at scale, or to interfere with its operation.

The license ends when a visitor stops using the site or when the office revokes it. The office may revoke the license at any time, particularly where a visitor breaches these terms. On revocation, a visitor must stop using the site and must remove any saved copy made under the license.

Nothing in this section limits a fair use or another right that the law grants independently of these terms. The license is a permission, not a restriction on rights that the law already provides.

12. Prohibited Conduct

A visitor may not use this website to break the law or to harm another person. A visitor may not attempt to gain unauthorized access to the site, to the office systems or to the information of another client. A visitor may not introduce malicious code or interfere with the normal operation of the site.

A visitor may not use the site to send fraudulent inquiries, to impersonate another person, or to submit information that the visitor knows to be false. The office reports credible threats and fraud to the appropriate authorities.

A visitor may not scrape the site at a volume that degrades service for others, and may not use automated tools to harvest contact details. A visitor may not misrepresent an affiliation with the office or suggest that the office endorses a product or a service without written permission.

Where a visitor breaches this section, the office may suspend access, decline service and pursue any remedy the law provides.

13. Third Party Links and Resources

This website may link to the websites of carriers, regulators and other organizations. These links are provided for convenience. The office does not control the linked sites, does not maintain them, and is not responsible for their content or their practices.

A link does not imply an endorsement of a linked site, and the inclusion of a link does not mean that the office has verified the site. A visitor who follows a link does so at the visitor own discretion and should review the terms and the privacy notice of the destination.

Where the office links to a carrier so that a client can submit a form, the client deals with the carrier directly. The office is not a party to that exchange and cannot control its outcome.

14. Confidentiality

The office treats client information as confidential. It does not disclose client information except as described in the Privacy Policy, as the client authorizes, or as the law requires. The office expects the same care from the people it engages to support its work.

Confidentiality is not absolute. It may be limited by a lawful request, by a duty to report, or by a need to protect the office or another person from harm. Where a limit applies, the office will disclose only what the situation requires and will explain the limit to the client where it is permitted to do so.

A client who wishes the office to share information with a specific adviser, such as an accountant or a lawyer, may authorize that sharing in writing. The office will share only what the client authorizes and only for the purpose the client names.

15. Disclaimers

This website and its content are provided on an as is and as available basis. The office disclaims all warranties that the law allows it to disclaim, whether express or implied, including any implied warranty of merchantability, of fitness for a particular purpose and of non infringement.

The office does not warrant that the site will be uninterrupted, that it will be free of error, or that a defect will be corrected. The office does not warrant that a result obtained from the site or from a service will meet a client expectation.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions in this section apply only to the extent the law permits. Nothing in these terms limits a warranty or a right that the law does not allow to be limited.

16. Limitation of Liability

To the extent the law allows, BATT INS. AND FIN SVCS. INC. is not liable for indirect, incidental, special, consequential or punitive damages arising from the use of this website or from a service. This includes lost profit, lost data and the cost of substitute services.

Where liability cannot be excluded, the total liability of the office for a claim connected to an engagement is limited to the fee paid by the client for the particular service that gave rise to the claim. This limit applies to the engagement as a whole, not to each item within it.

The office is not liable for the acts or omissions of a carrier, an adjuster, a court or another third party. The office is not liable for a loss caused by information a client failed to provide or provided in error.

Nothing in this section limits liability that the law does not allow to be limited, including liability for fraud or for a duty that cannot be waived.

17. Indemnification

A visitor or client agrees to indemnify and hold harmless BATT INS. AND FIN SVCS. INC. and the people who work with the office from a claim, a loss or an expense that arises from a breach of these terms, from a misuse of the site, or from a violation of the law or the rights of another person.

This obligation includes reasonable legal fees connected to a claim. The office will give notice of a claim that is subject to this section and will cooperate in the response to it to the extent it is reasonable to do so.

This section does not apply where the claim arises from the office own negligence or from the office breach of these terms. The obligation is intended to allocate the cost of a client caused dispute, not to shift the cost of the office own conduct.

18. Termination and Suspension

The office may suspend or end access to this website at any time, without notice, where a visitor breaches these terms or where the office must act to protect the site or another person. The office may also stop offering a service for business reasons, and it will give reasonable notice to active clients when it does.

A client may end an engagement at any time by telling the office. Where an engagement ends, the office will provide the work completed to that point and will invoice for it as described in Section 7. The office will return or retain documents as the law and the client instruction require.

Sections that by their nature should survive an ending of these terms, including the sections on intellectual property, disclaimers, limitation of liability, indemnification and governing law, continue to apply after the ending.

19. Governing Law and Disputes

These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to a conflict of law rule that would call for another law. The office and a client agree that the state and federal courts located in Utah have jurisdiction over a dispute that is not resolved informally.

Before starting a formal proceeding, the parties agree to try to resolve a dispute through good faith discussion. A person with a concern should contact the office at billing@battinsfin.hair or by telephone at +12232230928 so that the matter may be addressed directly.

If a provision of these terms is found to be unenforceable, the remaining provisions continue in effect. The failure of the office to enforce a provision on one occasion does not waive the right to enforce it on another.

20. Changes to These Terms

The office may update these terms when its practices change or when the law changes. When an update is made, the effective date at the top of this page changes as well. The office encourages visitors to review this page from time to time so that they remain familiar with the current terms.

If a change is material, the office will take reasonable steps to bring it to the attention of the people it serves. Continued use of the site after an update takes effect constitutes acceptance of the updated terms.

A person who does not accept an update should stop using the site and may ask the office how the earlier terms continue to apply to an existing engagement.

21. Contact Information

Questions about these terms are welcome. The fastest way to reach the desk is by email at billing@battinsfin.hair. The office may also be reached by telephone at +12232230928 during business hours.

Written correspondence may be sent to BATT INS. AND FIN SVCS. INC., 116 N Adamswood Rd Ste 2, Layton - 84040-4004, United States (US). Please include enough detail for the office to identify the matter, and the office will respond as promptly as it can.

The office thanks every visitor and client who takes the time to read these terms. They exist so that the work of the ledger desk rests on a clear agreement, in the same way that every folio in the press rests on a clearly written page.
